Portugal pension deadlines for people who left

We list every obligation we have verified in Portugal's pension system that runs on a time limit for someone who no longer lives there. Each row says what starts the clock, how long it runs and what is lost, with the official source and the date we checked it. We hold 13 rows for Portugal. Where an official source is silent, we say so on the row rather than guess.

Pick the year and we open the free checker with Portugal already selected.

How long
Five years where the survivor is under 35 at the date of death; unlimited if 35 or over.
What is lost
Applying late costs years of entitlement as well as arrears: the five years run from the death, not from the application.

Survivor pensions run five years where the survivor is under 35, and without limit where the survivor is 35 or over, judged at the date of death, not the date of application. A widow under 35 who applies two years late loses 24 months of arrears and also two of her five years of entitlement.

How long
Five years from the date the benefit was put at the claimant's disposal with their knowledge.
What is lost
Prescribes in favour of the paying institution - money already awarded is lost.

Lei 4/2007 art. 69: pecuniary benefits already due prescribe in favour of the paying institution after FIVE YEARS, counted from the date they were put at the claimant's disposal WITH THEIR KNOWLEDGE - not from when entitlement arose. Money already awarded can still be lost.

Never before the application date or the date verification was initiated.
What is lost

DL 187/2007 art. 50: the invalidity pension can never start before the application date or the date official verification was initiated - even where a medical board back-reports incapacity to an earlier date.

What starts the clock
Date the pension application (pedido) is submitted
How long
Pension due from the date indicated in the application, never earlier than the application date; application possible up to three months before the desired start date
What is lost
the source does not state what happens if this is missed

The Instituto da Segurança Social's Guia Prático for the old-age pension states that the pension is due from the date indicated in the application, provided that date is not earlier than the application itself. The application can be made when three months or less remain before the date on which the person wishes the pension to start.

What the source does not say

The Guia's wording is 'a partir da data indicada no pedido, desde que não anterior a este'. The Guia does not state in words that earlier months are lost, so we do not state a consequence. We have not read the statute, Decreto-Lei 187/2007; this entry rests on the ISS Guia Prático 7001 v4.71, published on 14 February 2025, sections D1.4 and C1.4. The gov.pt service page for applying for the old-age pension (updated on 23 March 2026) states the 3-month window but not the rule against retroactivity.

How long
From the date the application is presented; never earlier. No backdating at all.
What is lost
Every month between reaching pension age and applying is lost for good, not deferred.

The old-age pension is due from the date the application is presented (or a later date the beneficiary names) and never earlier. There is no backdating at all. Someone who reaches pension age at 66 and applies at 70 loses those four years of pension for good; they are not deferred. The rule is in DL 187/2007 art. 51 and in two official guides; the guide on cross-border cases says 'mas nunca anterior aquela'.

PortugalBackdating limit
What starts the clock
The source does not state what starts the clock
How long
Within six months of the death registration for arrears from the month after death.
What is lost
Claimed later, the pension runs only from the month after the application; the right survives, the arrears do not.

The survivor's pension right SURVIVES but the arrears do not. Requested within six months of the death registration it runs from the month after the death; requested later it runs only from the month after the application. The guide also says it 'pode ser requerida a todo o tempo'. So a widow abroad who takes two years to find out loses roughly twenty-four months of pension while keeping the right. Land both halves together. HIGH-VALUE-PENDING, NOT VERIFIED - same DL 322/90 gap as the death grant.

No more than three months before the intended start date.

And you cannot file early either: DL 187/2007 art. 76 n.4 caps the application at a maximum of THREE MONTHS in advance. Combined with the no-backdating rule this is a narrow window - too early is rejected, too late is unrecoverable.

How long
Within 180 consecutive days from the date the death is registered.

Death grant (subsidio por morte): the application must be made within a maximum of 180 consecutive days counted from the date the death is registered, not from the death itself. Read the trigger carefully: for a death abroad, registration can itself be delayed, which moves the clock. The statute behind this deadline, DL 322/90, could not be read in a usable form (the 1990 gazette PDF is a scan without searchable text), so this rests on an official administrative guide and has not been verified against the statute.

How long
Contributions by the 20th of the following month; enrolment lost if payment is not resumed within ONE YEAR of the last payment.
What is lost
Enrolment in the voluntary scheme is lost.

Voluntary insurance, two nested clocks: contributions are due by the 20th of the month following the month they relate to; and enrolment in the voluntary scheme is LOST if payment is not resumed within one year of the last payment. This is the buy-back window emigrants most often let lapse without knowing it closed.

What starts the clock
The source does not state what starts the clock
How long
Annually 1 May to 15 September. The 2026 cycle closes on 15 September 2026. Extension to 15 October only where an attempt was made inside the window and could not be completed.
What is lost
Payment of the pension is suspended from the first day of the month after the applicable deadline expires. Resumption on completion is retroactive to the date suspension began (art. 17), so nothing is forfeited.

Portaria n.o 274/2025/1, artigo 3.o: proof of life is done annually between 1 May and 15 September. Artigo 18.o n.1 b) sets the 2026 group as pensioners older than the normal old-age access age who live in six countries: Switzerland, Luxembourg, the Netherlands, Belgium, Cape Verde and the United Kingdom. Canada is not in the 2026 list. The Portaria states no age figure; it says 'idade superior a idade normal de acesso a pensao de velhice'. The figure of 66 years and 9 months comes from an administrative guide, not from the Portaria. An extension to 15 October applies where an attempt was made within the deadline and could not be completed (artigo 10.o n.3 and artigo 13.o n.4), for the documentary route as well as the digital one. It is not a general extension for anyone who simply did not act. Consequence (artigos 15.o and 16.o): payment of the pension is suspended from the first day of the month after the applicable deadline expires.

Buy-back is authorised only for the ENTIRE proven period of activity; payable in up to 36 monthly instalments.
What is lost
You cannot buy only the cheapest years - it is all or nothing.

The arrears buy-back is ALL OR NOTHING: authorisation to pay already-prescribed contributions is granted only for the ENTIRE period of activity actually proven. A claimant CANNOT cherry-pick the cheapest years to reach the 15-year prazo de garantia. Payable in up to 36 equal monthly instalments. Domestic service carries a separate 12-month look-back exclusion.

How long
From 2027, all pensioners resident abroad, on the 1 May to 15 September cycle.
What is lost
Payment suspended for non-compliance (art. 15/16); resumption is retroactive (art. 17).

Artigo 18.o n.1 c): from 2027 the proof-of-life duty applies to all pensioners resident abroad, with no country restriction and no age restriction stated in that paragraph. Anyone drawing a Portuguese pension outside Portugal is covered from 2027, on the 1 May to 15 September cycle, with suspension for non-compliance. It is the widest-reaching Portuguese obligation in this register.
