Why it matters

The labour-claim limitation moved: it is now 2 YEARS from termination (Decree-Law 9/2024, eff. 30 Aug 2024), not 1 year from due date, and MOHRE now issues binding awards for claims ≤ AED 50,000; DEWS pots are claimable from abroad.

If you do nothing

Unpaid gratuity becomes overdue employer debt 14 days after exit; the 2-year limitation then extinguishes the claim itself (unlike a pension, the clock destroys the asset). DEWS money may stay invested indefinitely.

Deadlines that matter in the UAE

  • Limitation: 2 years from termination (Decree-Law 9/2024), the asset-destroying deadline
  • Payment deadline: 14 days from end of service (then overdue debt)
  • MOHRE appeal: 15 working days against a ≤ AED 50k decision
  • DIFC split: Service before 1 Feb 2020 = frozen gratuity; from 1 Feb 2020 = funded DEWS pot

The UAE is structurally different, there is no register to search because the entitlement (End-of-Service Gratuity) is a debt the employer owes, not a fund balance held somewhere. The biggest under-calculation in this market is the basic-vs-gross contract distinction; getting that line right is what determines whether the number is correct.

From abroad: DEWS pots (DIFC-era) pay internationally; gratuity from outside the UAE is harder than from inside, because the leverage that exists with an employer evaporates once the employee has gone and the 2-year limitation clock under Decree-Law 9/2024 starts running on the asset itself, not just the claim.
