- What starts the clock
- Date the member ceased to be a South African tax resident (SARS: the fund administrator must confirm the uninterrupted three-year period from that date).
- How long
- After three uninterrupted years of non-residence; route effective 1 March 2021; vested and retirement components accessible from 1 September 2024. The former 'emigration withdrawal' route closed for SARB emigrations after 28 February 2022 and directive applications after 1 September 2024 (passed).
- What is lost
- SARS states a directive application will be declined where the documents provided do not prove the uninterrupted period of three years or longer from the date of ceasing to be a resident, or where the taxpayer has not informed SARS that they have ceased to be a resident; applications citing 'Emigration Withdrawal' on or after 1 September 2024 are no longer accepted.
SARS's tax-directive guide states that, effective 1 March 2021, a member of a retirement annuity fund who has stopped contributing and who has ceased to be a South African tax resident for an uninterrupted period of three years or longer on or after 1 March 2021 may withdraw the full benefit before electing to retire from the fund. The old 'emigration withdrawal' route (SARB-recognised financial emigration) was only available for emigrations accepted by SARB on or before 28 February 2022, and directive applications using that reason are no longer accepted from 1 September 2024 as the enabling legislation has been repealed. From 1 September 2024 the withdrawal covers the full value in the vested and retirement components.
