Spain pension deadlines for people who left

We list every obligation we have verified in Spain's pension system that runs on a time limit for someone who no longer lives there. Each row says what starts the clock, how long it runs and what is lost, with the official source and the date we checked it. We hold 18 rows for Spain. Where an official source is silent, we say so on the row rather than guess.

Pick the year and we open the free checker with Spain already selected.

What starts the clock
la fecha del hecho causante (the date of the triggering/qualifying event for the pension)
How long
Application filed more than three months after the hecho causante: retroactive effects are capped at three months, counted back from the date the application is filed.
What is lost
los efectos serán retroactivos durante un máximo de tres meses desde la fecha de la solicitud (the pension's economic effects are backdated only three months from the date of the application, meaning any part of the delay beyond three months is not paid retroactively)

The applicant nominates the effective date (hecho causante) of the retirement pension, and that date must fall within three months either side of the application. Payable retroactivity is capped at three months from the application, so a pension applied for more than three months after the nominated date is paid back only three months from the application, not from the nominated date itself. Corrected 3 October 2026 against seg-social.es.

What the source does not say

The page as fetched does not cite a specific Ley General de la Seguridad Social article number for this three-month cap; only the operative rule text was retrievable, not a statute cross-reference on the same page.

la fecha de presentación de la solicitud (the date the application for the convenio especial is submitted)
How long
Puedes darte de alta en cualquier momento, no fixed deadline; but effects only run from the first day of the month after the request is filed, with no retroactive coverage stated.
What is lost
the source does not state what happens if this is missed

Spanish nationals who are emigrants, and children of emigrants who hold Spanish nationality, can subscribe to a special agreement (convenio especial) with Spanish Social Security that requires no prior contribution period, and is not conditional on the country involved having a Social Security agreement with Spain. Registration can be made at any time; the agreement's effective date is fixed as the first day of the month following the date the application is submitted, so nothing is backdated to the emigration date.

What the source does not say

The page states no penalty or lost right for not subscribing, because it states no deadline for subscribing; it only ties the date from which contributions count to the date the request is filed. It does not repeat the older condition in Real Decreto 996/1986, published on boe.es, that once limited this agreement to countries without a bilateral Social Security agreement with Spain. The current seg-social.gob.es guide states that no such country restriction applies, and as the current official guidance it is treated as the rule that applies now.

What is lost
The page states the agreement is extinguished "por la falta de pago de las cuotas correspondientes a dos trimestres consecutivos" - for non-payment of the contributions for two consecutive quarters.

Under the convenio especial for Spanish emigrants and their children working abroad, contributions are payable quarterly in arrears within the month following each calendar quarter, and the agreement is extinguished if the contributions for two consecutive quarters go unpaid.

What starts the clock
el momento de causar el derecho (the moment the entitlement to the pension arises)
How long

What is lost

To have a right to a retirement pension, a person needs a minimum of 15 years (5,475 days) of contributions in total, of which 2 years must fall within the 15 years immediately before the moment the right to the pension arises (causar el derecho).

What the source does not say

The page gives the periods as two separate items (a general period and a specific period). It does not explain in prose on the same page what happens if the condition of 2 years within the last 15 is not met, so we do not state a consequence.

How long
4 years from the date the payment was received, or from when the repayment action could be exercised
What is lost
The page states the obligation to repay "prescribirá a los 4 años" - it is time-barred after 4 years.

Spain's right to require repayment of benefits that were wrongly paid to a person expires after 4 years, counted from the date the money was collected or from when the repayment action could have been exercised - including where the overpayment was the managing entity's own error.

1 de enero de 2026 for the first accreditation window; the article states a second window opens in the month of September 2026

What is lost

Pensioners of the Spanish Social Security system who live abroad must periodically certify that they are alive in order to keep receiving their pension without interruption. For 2026 the official campaign confirms this must be done twice in the year: once in the window from 1 January to 31 March, and a second time in September, described as a new feature for 2026.

What the source does not say

The article gives exact dates (1 January, 31 March) for the first window but names only the month for the September window. It cites no statute or ministerial order for the September window, and it does not state what happens to payment if a pensioner does not prove they are alive (acreditar la vivencia). We found no sentence on the consequence anywhere in the article.

How long
More than 90 days after the request or summons
What is lost
The page states reinstatement occurs "con una retroactividad máxima de 90 días" - with a maximum of 90 days' retroactivity.

If a pensioner produces requested documents or appears before the managing entity more than 90 days after being asked, the suspended pension is reinstated with a maximum of 90 days' backdating - the payments beyond that are not paid.

What starts the clock
The fecha del hecho causante (e.g. the day of the baja on ceasing work, for case 1).
How long
Apply within the 3 months following the hecho causante to keep full effects from the day after it.
What is lost
When the application is filed after the three months following the hecho causante (in cases 1-4), the economic effects have a maximum retroactivity of three months from the application.

Seguridad Social states that the economic effects of a contributory retirement pension run from the day after the hecho causante; the hecho causante date chosen by the applicant must fall within the three months before or after the application; and in the listed special cases (worker registered in a regime who ceases work, posted workers abroad, forced leave for public office, special agreements for parliamentarians/international officials) an application filed more than three months after the hecho causante has a maximum retroactivity of three months from the application.

What the source does not say

The page limits the three-month maximum to cases 1 to 4. A separate rule applies where unemployment benefit ends on reaching retirement age: effects run back to the end of that benefit if the application is made within 3 months of the resolution becoming final, otherwise for a maximum of 3 months. The page is titled 'Seguridad Social: Prestaciones / Pensiones de Trabajadores', section 'Hecho causante y efectos económicos'.

What starts the clock
The event that gives the right to subscribe ('desde que se produce la causa que te permite suscribir el convenio especial ordinario'), e.g. the baja.
How long
Within 1 year of the qualifying event; within the first 90 calendar days to be able to choose effect from the day after the baja.
What is lost
the source does not state what happens if this is missed

The Seguridad Social (Importass guide) states there is a one-year period, from the event that allows subscription, to register for the ordinary convenio especial; if the application is filed within the first 90 calendar days the agreement can take effect from the day after the baja, otherwise it takes effect from the date of registration.

What the source does not say

The page states the one-year period but not what happens after it ends. Filing after 90 calendar days means the agreement takes effect only from the registration date, as the page states. The seg-social.es information page 'Convenio especial ordinario' returned no content when we read it. The statutory basis is Orden TAS/2865/2003, which the page does not cite.

How long
Within 1 year, generally running from the day after the effective date of the baja (deregistration)
What is lost
The page states the 1-year filing is "necesario" in order to be able to sign the convenio especial - i.e. the source makes the 1-year window a condition of being able to subscribe at all.

To sign up to the ordinary convenio especial (voluntary continued contributions to Spanish Social Security), the application must be submitted within 1 year, counted for most people from the day after the effective date of deregistration from the Social Security scheme.

What is lost
the source does not state what happens if this is missed

Seguridad Social states that Spanish Social Security pensioners resident abroad must periodically accredit that they are alive: in 2026 twice (in the January-March period and in September); from 2027 three times a year (January, May and September).

What the source does not say

The source page states the cadence but no consequence. The Seguridad Social magazine (revista.seg-social.es, article of 2 January 2025) reports that pensions 'quedaron suspendidas por no acreditar la vivencia dentro del plazo de la campaña'; that is not on the authority's information page. The older INSS FAQ page ('Acredita tu vivencia') still says proof is presented 'todos los años, dentro del primer trimestre natural', so it has not been updated to the 2026 and 2027 cadence. The January to March 2026 window has passed; the September 2026 window is upcoming.

la fecha de la aportación (the date each contribution was made) determines when its ten-year seniority is reached; for the transitional group, the fixed reference point is 31 de diciembre de 2015
How long
General rule: contributions become disposable once they have at least ten years' seniority. Transitional rule: rights from contributions made up to 31 December 2015 are available from 1 January 2025.
What is lost
the source does not state what happens if this is missed

Participants in individual and associated pension plans may withdraw, in whole or in part, the consolidated rights corresponding to contributions made at least ten years earlier. As a transitional rule, rights from contributions made up to 31 December 2015 became available from 1 January 2025, which is the mechanism that made all pre-2016 pension plan money withdrawable from that date.

What the source does not say

This is a withdrawal right created for the participant's benefit, not an obligation with a deadline, so the source naturally states no penalty for not withdrawing. The row is included because it fixes the specific date, 1 January 2025, on which pre-2016 pension plan contributions became liquid, which is the fact requested. The current consolidated, in-force text of the same provision lives at boe.

la fecha de defunción (the date of death of the insured person), for the fifteen-day access rule stated in Article 6
How long
Article 6: the Registry can only be accessed once fifteen days have elapsed since the date of death. Article 4.2.a): pension-commitment insurance regulated by RD 1588/1999 is excluded from the Registry's scope at all times, with no time limit stated on that exclusion.
What is lost
the source does not state what happens if this is missed

The law creating the Ministry of Justice's Registro de Contratos de Seguros de cobertura de fallecimiento explicitly excludes from its scope insurance policies that instrument company pension commitments (compromisos por pensiones) with workers and beneficiaries, as regulated by Real Decreto 1588/1999. Separately, the same law states that access to the Registry can only take place once the insured person has died and at least fifteen days have elapsed since the date of death.

What the source does not say

The statute itself does not use the phrase 'heirs are sent to the wrong register'; that framing is our own read of the practical effect of the Article 4.2.a) exclusion combined with the Article 6 access rule, not a sentence on the page. The text also does not state what heirs should do instead when the deceased's death cover was in fact a pension-commitment policy under RD 1588/1999.
