A death pension is paid from the date of death only if it is claimed within 90 days of the death (180 days for children under 16).
What is lost: The source states this in item II of the same Art. 74: "II - do requerimento, quando requerida após o prazo previsto no inciso I" - [PensionHunter translation, not the source's own English] "II - of the claim, when claimed after the period provided for in item I." Where the claim is made after the 180/90 days, the pension is due from the date of the claim instead of from the date of death.
